Othersyders Referral Program Terms & Conditions

These Referral Program Terms & Conditions (“Terms”) govern participation in the Othersyders Referral Program (“Referral Program”) operated by The Othersyders Company (“Othersyders,” “we,” “us,” or “our”).

By submitting an application to participate in the Referral Program, registering as a referral partner, or participating in the Referral Program in any way, you (“Referral Partner,” “you,” or “your”) agree to these Terms.

If you do not agree to these Terms, do not participate in the Referral Program.

 

1. About the Referral Program

The Othersyders Referral Program allows approved participants to earn commissions by referring new customers, clients, subscribers, or users to Othersyders and qualifying products and services offered through Othersyders.online.

Referral Partners may promote Othersyders through word of mouth, social media, websites, personal networks, online communities, or other legitimate methods, provided that their promotional activities comply with these Terms and applicable laws.

Participation in the Referral Program does not guarantee that you will earn money. Commissions depend on successful, qualifying referrals and purchases.

 

2. Eligibility

To participate, you must:

• Provide accurate and complete information when applying.

• Be legally permitted to participate in a referral or commission program in your jurisdiction.

• Provide a valid email address and contact information.

• Provide accurate payment information.

• Agree to these Terms.

• Follow all applicable laws and regulations when promoting Othersyders.

• Follow any additional advertising, promotional, community, or website rules established by Othersyders.

Othersyders reserves the right to approve or reject any application at its discretion.

We may also suspend or terminate participation if we determine that a Referral Partner has violated these Terms or engaged in activity that could harm Othersyders, its customers, or its reputation.

 

3. Approval Is Required

Submitting a referral application does not automatically make you an approved Referral Partner.

Othersyders may review applications before approving participation.

We may request additional information when necessary to verify your identity, contact information, promotional activities, or payment information.

Only approved Referral Partners are eligible to receive commissions.

 

4. How Referrals Work

A Referral Partner introduces a person to Othersyders with the intention of encouraging that person to visit the website, purchase a qualifying product or service, subscribe to a qualifying program, or otherwise become a qualifying customer.

To receive credit, the referred person must identify the Referral Partner when making contact or completing the applicable transaction.

The referred person may provide:

• The Referral Partner's name;

• Referral nickname;

• Referral code;

• Other identifying information provided by Othersyders.

Othersyders may use reasonable methods to determine whether a referral qualifies.

 

5. Referral Credit

A referral will generally qualify when:

1. The person was referred by an approved Referral Partner;

2. The person identifies the Referral Partner;

3. The person completes a qualifying transaction or service;

4. The transaction is successfully completed and verified;

5. The transaction is not fraudulent, reversed, refunded, cancelled, or otherwise disqualified.

Othersyders' records will be used to determine whether a referral has been properly credited.

If more than one Referral Partner claims the same customer, Othersyders may determine which Referral Partner receives credit based on the information available to us.

Othersyders' determination regarding referral attribution will be considered final unless we determine that an error occurred.

 

6. Commission Rate

Unless a different commission rate is specifically stated in writing, approved Referral Partners will receive a 10% commission on qualifying sales.

The commission is calculated on the qualifying amount actually received by Othersyders.

Unless otherwise stated, commissions do not include:

• Sales or other taxes;

• Shipping charges;

• Processing fees;

• Refunds;

• Discounts or promotional credits;

• Chargebacks;

• Cancelled transactions;

• Amounts not actually received by Othersyders.

For example, if a qualifying customer makes a $100 purchase and $100 is the qualifying amount received by Othersyders, the Referral Partner's commission would normally be $10.

 

7. Qualifying Transactions

Qualifying transactions may include eligible purchases, subscriptions, memberships, products, services, or other transactions offered through Othersyders.

Othersyders may determine which products, services, subscriptions, or transactions qualify for referral commissions.

Certain products, services, promotional offers, external transactions, or special arrangements may be excluded from the Referral Program.

If a transaction occurs through a third-party website, marketplace, payment processor, or service that Othersyders does not control, Othersyders may be unable to verify the transaction and therefore may be unable to pay a referral commission.

 

8. Services

If a referred person applies for or requests an Othersyders service, the referral does not automatically create a commission.

The referral must result in a qualifying transaction or service agreement and must be successfully verified.

If a service requires an application, consultation, approval, custom quote, or selection process, the commission is based on the qualifying amount actually paid after the service has been approved and completed or otherwise reached the qualifying payment stage established by Othersyders.

 

9. Subscriptions and Recurring Payments

If a referred customer subscribes to a qualifying Othersyders subscription, membership, or recurring service, commissions may be earned according to the commission structure applicable to that program.

Unless specifically stated otherwise, a Referral Partner should not assume that a commission will continue indefinitely for every recurring payment.

Othersyders may specify whether a particular subscription provides:

• A commission on the initial payment only;

• A commission on recurring payments for a defined period; or

• Another commission structure.

The applicable commission structure may be identified on the relevant Referral Program or product page.

 

10. Refunds, Cancellations and Chargebacks

A commission is not considered permanently earned until the underlying transaction has been successfully completed and is no longer subject to applicable refund, cancellation, or chargeback procedures.

If a transaction is:

• Refunded;

• Cancelled;

• Charged back;

• Reversed;

• Determined to be fraudulent;

• Determined to have been improperly credited; or

• Otherwise invalidated,

Othersyders may withhold the related commission.

If the commission has already been paid, Othersyders may deduct the reversed commission from future commissions or request repayment where appropriate.

 

11. No Self-Referrals

Referral Partners may not refer themselves in order to earn a commission on their own purchases.

You may not use another person's name, account, email address, payment account, or identity to disguise a self-referral.

Transactions created primarily for the purpose of generating referral commissions rather than making a legitimate purchase may be disqualified.

 

12. No Fake or Artificial Referrals

Referral Partners may not create fake customers, fake accounts, fraudulent purchases, fabricated leads, or artificial transactions to generate commissions.

You may not:

• Purchase products solely to generate a commission for yourself;

• Create multiple accounts to manipulate referral tracking;

• Use stolen payment information;

• Use another person's identity without authorization;

• Encourage people to create fraudulent transactions;

• Generate automated or fabricated referrals;

• Manipulate the referral process.

Suspected fraudulent activity may result in immediate suspension or termination.

 

13. No Spam

Referral Partners may not use spam or abusive promotional practices.

This includes, but is not limited to:

• Unsolicited mass email;

• Unsolicited bulk messaging;

• Automated spam;

• Repeated unwanted direct messages;

• Posting referral information where it is prohibited;

• Harassing individuals to obtain referrals;

• Sending promotional messages to people who have requested not to receive them.

Referral Partners are responsible for complying with applicable email, advertising, privacy, telecommunications, and anti-spam laws.

 

14. Truthful Promotion

Referral Partners must represent Othersyders and its products and services honestly.

You may not make false, misleading, exaggerated, or unsupported claims about:

• Othersyders;

• Products;

• Services;

• Pricing;

• Earnings;

• Discounts;

• Availability;

• Guarantees;

• Results;

• Other Referral Partners;

• The amount of money you may earn.

You may not guarantee that another person will make money by joining Othersyders or the Referral Program.

You may describe your own genuine experience, but you must not present personal experiences as guaranteed results for everyone.

 

15. No False Representation

Referral Partners may not represent themselves as employees, owners, officers, agents, official representatives, or authorized spokespersons of The Othersyders Company unless they have separately been authorized to do so.

You may describe yourself as an Othersyders Referral Partner, Othersyders Referral Member, or another designation specifically approved by Othersyders.

You may not claim that you own or operate Othersyders.online.

 

16. Advertising and Disclosure

If you promote Othersyders through social media, websites, videos, reviews, endorsements, or other public communications, you are responsible for making any disclosures required by applicable law.

If you receive compensation for recommending Othersyders, your audience should not be misled about your relationship with Othersyders.

Referral Partners should clearly disclose their relationship when appropriate, using straightforward language such as:

“I may receive a commission if you purchase through my referral.”

Referral Partners are responsible for complying with applicable advertising and endorsement requirements.

 

17. Use of Othersyders Branding

Othersyders may allow Referral Partners to use certain approved logos, graphics, links, promotional materials, or other branding assets.

These materials may only be used to promote Othersyders and the Referral Program.

You may not modify, distort, misuse, or represent Othersyders branding as your own.

Othersyders may revoke permission to use its branding at any time.

 

18. Domain Names and Social Media Accounts

Referral Partners may not register domains, social-media accounts, usernames, pages, groups, or other online identities that intentionally impersonate Othersyders or create confusion about whether they are officially operated by The Othersyders Company.

Referral Partners may not use Othersyders trademarks or branding in a manner that suggests official ownership or endorsement without authorization.

 

19. Referral Payment Information

Referral Partners are responsible for providing accurate payment information.

Othersyders may offer payment through methods such as:

• Cash App;

• PayPal;

• Other payment methods specifically approved by Othersyders.

Othersyders is not responsible for payments sent to incorrect information supplied by the Referral Partner.

If payment information changes, the Referral Partner must notify Othersyders promptly.

 

20. Commission Payment

Commissions will be paid after the qualifying transaction has been verified and any applicable waiting period has passed.

Othersyders may establish a minimum payout threshold before issuing a payment.

If a Referral Partner has not reached the applicable minimum payout amount, commissions may remain pending until the threshold is reached.

Othersyders may establish reasonable payment schedules and processing periods.

Payment timing may vary depending on transaction verification, refunds, payment processing, weekends, holidays, or other circumstances.

 

21. Taxes

Referral Partners are responsible for determining and fulfilling their own tax obligations arising from commissions received through the Referral Program.

Othersyders may be required to collect tax information or provide tax reporting documents when required by applicable law.

Providing payment information does not relieve a Referral Partner of their responsibility to comply with applicable tax laws.

 

22. Commission Disputes

If you believe a qualifying referral was not properly credited, you should contact Othersyders and provide as much information as possible, including:

• Your name;

• Referred customer's name;

• Date of referral;

• Product or service involved;

• Approximate purchase date;

• Any referral code used;

• Other information that may help verify the referral.

Othersyders may investigate disputed referrals.

Referral disputes should be reported within a reasonable period after the transaction.

 

23. Referral Tracking

Othersyders may use names, referral codes, forms, website records, customer statements, payment records, or other reasonable methods to track referrals.

Because referrals may sometimes occur through conversations, social media, or other methods that cannot be automatically tracked, Referral Partners are responsible for ensuring that referred customers identify them correctly.

Othersyders cannot guarantee that every referral will be automatically detected.

 

24. Customer Privacy

Referral Partners may not request, collect, purchase, sell, or misuse another person's private information for the purpose of generating referrals.

You should only provide Othersyders with information that the referred person has authorized you to provide or that they have voluntarily provided through the appropriate Othersyders process.

 

25. No Purchase Requirement for Referral Partners

Participation in the Referral Program does not require you to purchase Othersyders products or services.

Referral Partners should not purchase products solely for the purpose of generating referral commissions.

 

26. No Guarantee of Earnings

Othersyders makes no guarantee regarding the amount of money a Referral Partner will earn.

Some Referral Partners may earn substantial commissions, while others may earn little or nothing depending on the number and value of qualifying referrals they generate.

Past earnings or examples are not guarantees of future earnings.

 

27. Referral Program Changes

Othersyders may change the Referral Program from time to time.

Changes may include:

• Commission rates;

• Qualifying products;

• Payment methods;

• Minimum payout amounts;

• Referral procedures;

• Eligibility requirements;

• Promotional requirements;

• Program rules.

Where appropriate, significant changes will be communicated through the website, email, or another reasonable method.

 

28. Suspension or Termination

Othersyders may suspend or terminate a Referral Partner's participation if we believe the Referral Partner has:

• Violated these Terms;

• Engaged in fraudulent activity;

• Generated artificial referrals;

• Misrepresented Othersyders;

• Used spam;

• Violated applicable law;

• Misused Othersyders branding;

• Engaged in conduct that could harm Othersyders or its customers;

• Provided false or misleading information.

Othersyders may also discontinue the Referral Program entirely.

 

29. Effect of Termination

When participation ends, the Referral Partner must stop representing themselves as an active Othersyders Referral Partner and stop using any referral materials or branding that Othersyders has provided.

Qualifying commissions earned before termination may remain payable, subject to verification and any applicable refund, cancellation, chargeback, fraud, or other adjustments.

Commissions associated with fraudulent, invalid, or otherwise disqualified transactions will not be payable.

 

30. No Transfer of Referral Accounts

Referral accounts and referral relationships may not be sold, transferred, assigned, or given to another person without written authorization from Othersyders.

 

31. Independent Relationship

Participation in the Referral Program does not create an employment relationship between the Referral Partner and The Othersyders Company.

Referral Partners are independent participants and are responsible for their own expenses, taxes, equipment, advertising, internet access, transportation, and other costs associated with their promotional activities.

Nothing in the Referral Program creates a partnership, franchise, joint venture, agency, or fiduciary relationship.

 

32. Intellectual Property

All Othersyders trademarks, logos, website content, graphics, designs, names, and other intellectual property remain the property of their respective owners.

Participation in the Referral Program does not give a Referral Partner ownership of any Othersyders intellectual property.

 

33. Third-Party Products and Services

Some products, services, stores, or opportunities promoted through Othersyders may involve third-party providers.

Othersyders may establish different commission rules for transactions involving third parties.

If Othersyders cannot verify a transaction because it occurred outside systems controlled by Othersyders, no commission is guaranteed.

 

34. Website Availability

Othersyders does not guarantee that the website, referral forms, referral tracking systems, or other program features will always be available or operate without interruption.

Technical problems, maintenance, third-party services, internet outages, or other circumstances may temporarily affect referral tracking or program functionality.

 

35. Limitation of Liability

To the maximum extent permitted by applicable law, The Othersyders Company will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from participation in the Referral Program or inability to participate in the program.

Othersyders' liability relating to a particular referral or commission will, to the maximum extent permitted by law, be limited to the amount of commission actually owed for that referral.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

 

36. Indemnification

To the extent permitted by applicable law, the Referral Partner agrees to defend, indemnify, and hold harmless The Othersyders Company and its owners, officers, employees, contractors, representatives, and agents from claims, damages, liabilities, losses, costs, and expenses arising from the Referral Partner's:

• Violation of these Terms;

• Violation of applicable law;

• Fraudulent or deceptive conduct;

• Unauthorized advertising;

• Infringement of third-party rights;

• Misuse of Othersyders branding;

• Promotional activities; or

• Misrepresentation of Othersyders or its products and services.

 

37. Governing Law

These Terms will be governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except where applicable law requires otherwise.

 

38. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

 

39. Entire Agreement

These Terms, together with the Referral Program application, applicable Othersyders policies, and any written terms specifically provided for a particular referral arrangement, constitute the agreement governing participation in the Othersyders Referral Program.

 

40. Acceptance of Terms

By submitting the Referral Program application, checking the required agreement box, or participating in the Referral Program, you acknowledge that you have read, understood, and agree to these Terms.
