Othersyders Advertising Terms & Conditions

Effective Date: October 3, 2026

These Advertising Terms & Conditions (“Terms”) govern the purchase, submission, approval, placement, display, and use of advertising on Othersyders.online, operated by The Othersyders Company (“Othersyders,” “we,” “us,” or “our”).

By submitting an advertising application, purchasing advertising, submitting advertising materials, or authorizing an advertisement to appear on Othersyders.online, the advertiser (“Advertiser,” “you,” or “your”) agrees to these Terms.

1. Advertising Approval

All advertisements submitted to Othersyders are subject to review and approval.

Payment, submission of an advertising application, or previous approval of an advertisement does not guarantee acceptance of any current or future advertisement.

Othersyders reserves the right to approve, reject, request modification of, suspend, or remove advertising that we reasonably determine violates these Terms, our site policies, applicable law, or the standards of the Othersyders platform.

Approval of an advertisement does not constitute an endorsement of the Advertiser, its products, services, statements, organization, or business practices.

2. Advertiser Responsibility

Advertisers are solely responsible for the accuracy, legality, and content of the advertising materials they submit.

Advertisers must ensure that all claims, statements, prices, offers, descriptions, testimonials, representations, and other information contained in their advertisements are truthful and not misleading.

Where substantiation is legally required for an advertising claim, the Advertiser is responsible for possessing adequate substantiation before submitting the advertisement.

Federal truth-in-advertising principles generally require advertisements to be truthful and non-deceptive and advertisers to possess evidence supporting claims where appropriate. Federal Trade Commission

3. Prohibited Advertising

Othersyders may refuse advertisements promoting or containing:

  • Illegal products, services, activities, or transactions.

  • Fraudulent, deceptive, misleading, or materially inaccurate claims.

  • Malware, phishing, malicious downloads, scams, or deceptive websites.

  • Stolen or counterfeit merchandise.

  • Content that infringes copyrights, trademarks, publicity rights, privacy rights, or other intellectual-property rights.

  • Unauthorized use of another person's image, identity, brand, artwork, music, video, or other protected material.

  • Hate speech, unlawful discrimination, threats, harassment, or incitement of violence.

  • Exploitative or unlawful sexual content.

  • Human trafficking or exploitation.

  • Advertising deliberately designed to impersonate Othersyders or another person or organization.

  • Products or services whose promotion would violate applicable federal, state, or local law.

  • Any other material Othersyders determines is inappropriate for its platform.

Othersyders may establish additional restrictions for particular advertising categories.

4. Regulated Products and Services

Advertisers promoting regulated industries, products, or services are responsible for complying with all applicable licensing, age, geographic, disclosure, targeting, and advertising requirements.

Othersyders may impose additional restrictions on advertising involving subjects such as financial products, healthcare, supplements, gambling, alcohol, cannabis, tobacco or nicotine products, political advertising, adult-oriented businesses, weapons, or other regulated industries.

Acceptance of an advertisement by Othersyders does not constitute a determination that the advertisement complies with applicable law.

5. Advertising Claims and Disclosures

Advertisers are responsible for including all disclosures, disclaimers, qualifications, warnings, and other information legally required for their advertisements.

Required disclosures must not be deliberately hidden, obscured, or contradicted by the advertisement.

The FTC advises that disclosures necessary to prevent deception should be clear and conspicuous and presented so consumers can notice and understand them. Federal Trade Commission

Othersyders may require an Advertiser to revise an advertisement when we believe additional disclosure or clarification is appropriate.

6. Testimonials, Reviews and Endorsements

Any testimonial, endorsement, rating, review, influencer statement, or similar representation appearing in an advertisement must comply with applicable advertising requirements.

Advertisers are responsible for disclosing material relationships where required, including compensation, free products, employment relationships, sponsorships, or other connections that could affect how consumers evaluate an endorsement.

The FTC's Endorsement Guides address these disclosure requirements and require endorsements to be truthful and not misleading. Federal Trade Commission

7. Advertising Materials

Advertisers are responsible for supplying materials in the specifications requested by Othersyders.

Materials may include images, banners, videos, logos, written copy, URLs, calls to action, business information, promotional codes, or other content required for the selected placement.

Othersyders is not responsible for delays caused by incomplete, incorrect, corrupted, incompatible, or late materials supplied by the Advertiser.

8. Intellectual Property

The Advertiser represents and warrants that it owns or has obtained all rights, licenses, permissions, and authorizations necessary to use and advertise all submitted materials.

This includes, where applicable, copyrights, trademarks, photographs, artwork, logos, music, videos, likenesses, names, testimonials, and other intellectual property.

The Advertiser retains ownership of its advertising materials.

By submitting advertising materials, the Advertiser grants The Othersyders Company a non-exclusive, worldwide, royalty-free license during the advertising campaign and for reasonable administrative or archival purposes to reproduce, resize, format, display, distribute, and otherwise use the submitted materials as necessary to provide the purchased advertising services.

This license does not transfer ownership of the Advertiser's intellectual property to The Othersyders Company.

9. Advertisement Modifications

Othersyders may make minor technical modifications necessary to properly display advertising, including resizing, compression, formatting, or placement adjustments.

We will not intentionally make material changes to the meaning of an advertisement without the Advertiser's authorization.

If substantial changes are required, Othersyders may request revised materials from the Advertiser.

10. Advertising Placement

Unless a specific placement is expressly guaranteed as part of the purchased advertising package, advertising location may vary according to site design, device type, screen size, availability, and platform requirements.

Advertisements may display differently on desktop computers, tablets, and mobile devices.

Purchasing advertising does not grant the Advertiser ownership or permanent control of any portion of Othersyders.online.

11. Campaign Dates

Advertising will normally run for the period associated with the purchased advertising package or otherwise agreed upon by Othersyders and the Advertiser.

Advertisers are responsible for providing materials sufficiently in advance of their requested start date.

If an advertising campaign is delayed because the Advertiser failed to provide required materials, information, approvals, or corrections, Othersyders may adjust the campaign dates when reasonably practicable but is not required to compensate the Advertiser for delays caused by the Advertiser.

12. Changes to Advertised Content

Approval applies to the advertisement and destination content reviewed by Othersyders.

Advertisers may not materially change the destination page, product, service, offer, or other content associated with an approved advertisement in a manner that would cause the advertisement to violate these Terms.

Othersyders may suspend or remove an advertisement if the destination content materially changes after approval.

13. Payment

Advertising fees must be paid according to the pricing and payment terms displayed at the time of purchase or otherwise agreed upon in writing.

Advertising will not be considered confirmed until all required payments and materials have been received unless Othersyders expressly agrees otherwise.

Advertisers are responsible for applicable taxes, fees, or other charges associated with their purchase where required by law.

14. Cancellations and Refunds

An Advertiser may request cancellation before a campaign begins.

Unless otherwise stated at the time of purchase, advertising that has already begun running is generally non-refundable.

If Othersyders rejects an advertisement before publication and the Advertiser has already paid for the placement, Othersyders may allow the Advertiser to submit replacement advertising or issue an appropriate refund for advertising that was not provided.

No refund will ordinarily be provided when an advertisement is removed because the Advertiser violated these Terms, supplied misleading information, infringed third-party rights, or violated applicable law.

Nothing in this section limits any refund or consumer right that cannot legally be waived.

15. Advertising Performance

Othersyders does not guarantee any particular number of:

Views, impressions, clicks, sales, customers, leads, followers, subscribers, conversions, revenue, engagement, or other results unless a particular metric is expressly guaranteed in writing as part of the purchased advertising package.

Advertising performance can vary substantially depending upon the advertisement, audience, placement, offer, campaign length, and other factors.

16. No Endorsement

The appearance of an advertisement on Othersyders does not mean The Othersyders Company recommends, guarantees, certifies, sponsors, or endorses the Advertiser or its products or services unless we expressly state otherwise.

Paid advertising may be identified using labels such as Advertisement, Sponsored, Paid Promotion, or similar language where appropriate.

This distinction is particularly important when advertising resembles surrounding editorial or platform content; FTC guidance applies truth-in-advertising principles to native and deceptively formatted advertising. Federal Trade Commission

17. Advertiser and Customer Transactions

Othersyders provides advertising space and promotional services.

Unless expressly stated otherwise, The Othersyders Company is not a party to transactions between an Advertiser and a customer who discovers that Advertiser through Othersyders.

The Advertiser is solely responsible for its products, services, fulfillment, shipping, warranties, refunds, customer service, taxes, licenses, regulatory obligations, and disputes with its customers.

18. Third-Party Websites

Advertisements may direct users to websites, stores, social-media accounts, applications, or services operated by third parties.

Othersyders does not control those third-party services and is not responsible for their availability, security, privacy practices, products, services, content, or business practices.

19. Suspension and Removal

Othersyders may immediately suspend or remove advertising when reasonably necessary because of suspected fraud, unlawful activity, security threats, intellectual-property complaints, misleading advertising, material violations of these Terms, or potential harm to Othersyders or its users.

Where appropriate, we may allow the Advertiser an opportunity to correct the issue.

20. Indemnification

To the extent permitted by applicable law, the Advertiser agrees to defend, indemnify, and hold harmless The Othersyders Company and its owners, officers, employees, contractors, representatives, and agents from third-party claims, damages, liabilities, losses, costs, and reasonable legal expenses arising from or relating to:

The Advertiser's advertising materials; products or services; breach of these Terms; violation of applicable law; infringement of intellectual-property or other third-party rights; or fraudulent, misleading, or unlawful advertising.

21. Limitation of Liability

To the maximum extent permitted by applicable law, The Othersyders Company will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from an advertising campaign, including lost profits, lost sales, lost business opportunities, or anticipated advertising results.

To the maximum extent permitted by applicable law, The Othersyders Company's aggregate liability arising from a particular advertising campaign will not exceed the amount actually paid to Othersyders for the advertising campaign giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

22. Technical Interruptions

Othersyders does not guarantee uninterrupted website availability.

Temporary interruptions may occur because of maintenance, hosting problems, internet outages, software problems, security incidents, third-party services, or circumstances outside our reasonable control.

When a substantial technical interruption materially prevents a paid advertisement from being displayed, Othersyders may, at its discretion and where reasonably practicable, extend the advertising period or provide comparable replacement advertising time.

23. Referrals and Advertising Agents

If an Advertiser was referred by an Othersyders referral partner, affiliate, advertising representative, or other authorized agent, the Advertiser should provide the requested referral information during the application or purchasing process.

Commission arrangements between The Othersyders Company and its agents or referral partners do not increase the Advertiser's rights under these Terms unless expressly stated otherwise.

24. Privacy

Information collected from Advertisers may be used to process advertising applications, communicate with Advertisers, process transactions, administer campaigns, prevent fraud, maintain business records, and comply with legal obligations.

Personal information will be handled according to the applicable Othersyders Privacy Policy.

25. Independent Businesses

Purchasing advertising does not create an employment, partnership, franchise, agency, joint venture, fiduciary, or other business relationship between the Advertiser and The Othersyders Company beyond the advertising services expressly purchased.

Advertisers may not represent themselves as employees, official representatives, partners, or agents of The Othersyders Company unless separately authorized in writing.

26. Changes to These Terms

The Othersyders Company may update these Advertising Terms & Conditions from time to time.

Changes will apply prospectively according to the effective date of the updated Terms. Advertising already purchased will remain subject to the terms applicable to that purchase unless a change is required by law or the parties otherwise agree.

27. Governing Law

These Terms will be governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Nevada maintains statutory provisions addressing deceptive trade practices in Chapter 598 of the Nevada Revised Statutes. Nevada Legislature

28. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

29. Entire Agreement

These Terms, together with the applicable advertising order, advertising package description, Privacy Policy, and other policies expressly incorporated into these Terms, constitute the agreement between the Advertiser and The Othersyders Company concerning the purchased advertising services.

30. Acceptance

By submitting an advertising application or purchasing advertising on Othersyders.online, the Advertiser acknowledges that they have read, understood, and agree to these Advertising Terms & Conditions.
